Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using 3DWebGen at 3dwebgen.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms referenced herein. If you do not agree to these Terms, you must not use the Service. We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the website. Your continued use of the Service after such notification constitutes acceptance.

2. Description of Service

3DWebGen is an AI-powered platform that provides the following services:

• Image to 3D — Upload an image (PNG, JPG, WebP) and generate a 3D model using AI, with optional multi-view mode (3 photo angles), textured mesh, and high quality settings
• Text to 3D — Enter a text description and generate a 3D model from natural language prompts
• GLB to STL Conversion — Convert GLB/glTF 3D model files to STL format for 3D printing, either via URL or direct file upload
• 3D Model Viewer — Preview generated 3D models in-browser with interactive rotation and zoom
• Generation History — Access and download previously generated 3D models from your account
• Blog — Educational articles, tutorials, product updates, and industry insights related to AI-powered 3D generation and 3D printing

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, specific uptime levels, or the quality of AI-generated outputs.

3. Account Registration and Security

• You may register using an email address and password, or through Google OAuth sign-in
• You must provide accurate and complete information during registration and keep it current
• You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account
• You must be at least 13 years old (or 16 in the EEA) to create an account and use the Service
• One account per individual. Creating multiple accounts to exploit free credits or circumvent restrictions will result in termination of all associated accounts
• You must notify us immediately at support@3dwebgen.com if you suspect unauthorized access to your account

4. Credit System

The Service operates on a credit-based system. Credits are consumed when you generate 3D models. The credit costs are as follows:

• Free tier — New accounts receive 15 free credits upon registration. No credit card required
• Paid plans — Starter (500 credits/month), Pro (2,000 credits/month), and Enterprise (10,000 credits/month) plans are available via monthly or yearly subscriptions
• Credit rollover — Unused credits carry over to the next billing period. Monthly credit allocations are added to your existing balance on each renewal date
• Auto-refund — If a generation fails due to an AI processing error, credits are automatically refunded to your account
• Non-transferability — Credits are non-transferable between accounts and cannot be exchanged for cash or other forms of payment
• Pricing changes — We reserve the right to modify credit costs, subscription pricing, and free credit allocations. Existing subscribers will be given 30 days notice before pricing changes take effect on their accounts

5. Subscriptions and Billing

• Subscriptions are processed through Polar, our payment provider. By subscribing, you also agree to Polar's terms of service
• Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless canceled before the renewal date
• You may cancel your subscription at any time through the customer portal. Upon cancellation, you retain access to your plan's features and remaining credits until the end of the current billing period
• Refunds for subscription payments may be requested within 7 days of the initial purchase or renewal, subject to review. Contact support@3dwebgen.com for refund requests
• If a payment fails, your subscription status will be marked as "past due." We may retry the payment and/or downgrade your account to the Free tier if payment is not resolved
• Plan upgrades take effect immediately with prorated billing. Plan downgrades take effect at the end of the current billing period

6. Email Communications

By creating an account, you agree to receive the following types of email communications from 3DWebGen:

6.1 Transactional Emails

These are essential service-related emails that you cannot opt out of while maintaining an active account. They include:

• Account verification and welcome emails
• Password reset requests
• Generation completion notifications
• Low credit balance warnings
• Subscription status changes (confirmation, renewal, cancellation, payment failure)
• Security alerts (suspicious login attempts, account changes)
• Critical service announcements (Terms of Service or Privacy Policy changes, planned downtime, data breach notifications)

6.2 Marketing and Promotional Emails

With your consent, we may send you marketing emails including:

• Product updates — New features, AI model improvements, platform enhancements
• Tips and tutorials — Guides on getting the most out of 3D generation, 3D printing tips, optimization techniques
• Promotional offers — Discounts, special credit bonuses, limited-time plan offers
• Blog content — New article notifications and curated content digests
• Campaign emails — Newsletters and announcements about the platform, community, and industry developments

6.3 Email Preferences and Unsubscribe

You have full control over your marketing email preferences:

• You can manage your email preferences (categories and frequency) through your account settings at any time
• Every marketing email includes a one-click unsubscribe link in the footer. Clicking this link will immediately remove you from that email category
• You may choose to receive emails in real-time, as a daily digest, or as a weekly digest
• Unsubscribe requests are processed immediately. It may take up to 48 hours for emails already in the send queue to stop
• Unsubscribing from marketing emails does not affect transactional emails related to your account and service usage

6.4 Email Tracking

Our emails may contain tracking technologies to help us understand how you interact with our communications:

• Open tracking — We use a small transparent tracking pixel (1x1 image) embedded in emails to detect when an email is opened. This records the time of opening
• Click tracking — Links in our emails may be routed through our tracking system to record click events, including which links were clicked and how many times. You are immediately redirected to the intended destination
• This tracking data is used solely to measure email engagement, improve our communications, and ensure we send relevant content. It is not shared with third parties
• If you prefer not to be tracked, you can disable image loading in your email client to prevent open tracking, and you may copy link URLs directly instead of clicking tracked links

7. Acceptable Use Policy

You agree not to use the Service for any of the following:

• Generating content that is illegal, obscene, threatening, harassing, defamatory, or that promotes violence, hatred, or discrimination
• Uploading images that contain illegal content, child exploitation material, or images you do not have the right to use
• Generating 3D models of weapons, explosives, or other dangerous items intended for harmful use
• Attempting to reverse-engineer, decompile, extract, or replicate the underlying AI models or algorithms
• Using automated scripts, bots, scrapers, or other automated means to access the Service without prior written authorization
• Deliberately overloading, disrupting, or interfering with the Service's infrastructure, servers, or networks
• Creating multiple accounts to abuse the free credit system or circumvent usage limits
• Reselling, sublicensing, or providing access to the Service to third parties without our written authorization
• Using the Service to infringe upon the intellectual property rights, privacy rights, or other rights of any third party
• Using any contact information obtained from the Service (including email addresses) to send unsolicited communications or spam
• Attempting to manipulate, forge, or spoof email headers or sender information to impersonate 3DWebGen or any other party
• Violating any applicable local, national, or international laws or regulations, including anti-spam legislation (CAN-SPAM, GDPR, CASL, and similar)

We reserve the right to investigate violations and take appropriate action, including warning, suspending, or terminating accounts, removing content, and reporting illegal activity to law enforcement.

8. Intellectual Property

8.1 Your Input Content

You retain full ownership of the images you upload and the text prompts you provide. By uploading content to the Service, you grant us a limited, non-exclusive, worldwide license to process your content through our AI systems solely for the purpose of generating 3D models as requested by you.

8.2 Generated 3D Models

3D models generated by the Service are yours to use without restriction. You may download, modify, adapt, combine, redistribute, sell, 3D print, use in games or applications, incorporate into commercial products, and otherwise exploit generated models for both personal and commercial purposes. You are not required to attribute 3DWebGen when using generated models.

8.3 Commercial License by Plan

All plans (including Free) grant you the right to use generated 3D models commercially. Pro and Enterprise plans additionally include enhanced commercial licensing with no revenue caps on products incorporating generated models.

8.4 Platform Intellectual Property

The 3DWebGen name, logo, website design, user interface, underlying technology, source code, and all associated intellectual property are owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the platform itself.

8.5 Blog and Email Content

All content published on the 3DWebGen blog and included in our email communications (text, images, graphics, tutorials, and guides) is our copyrighted material. You may share links to blog posts and forward emails, but you may not reproduce, republish, or distribute blog or email content in any commercial context without our prior written consent. Personal and educational use (such as quoting excerpts with attribution) is permitted.

9. AI-Generated Content Disclaimer

3D models are generated by artificial intelligence and are subject to inherent limitations:

• Generated models may contain geometric imperfections, non-manifold edges, holes, or topological errors
• Dimensional accuracy is not guaranteed. Models may not match exact real-world measurements
• Models are not structurally analyzed and should not be relied upon for load-bearing or safety-critical applications without independent validation
• Text-to-3D outputs may not exactly match the intended description due to AI interpretation limitations
• Textured meshes may have UV mapping artifacts or texture seam issues

You are solely responsible for inspecting, validating, and testing generated models before using them in production, manufacturing, 3D printing, or any application where accuracy and safety are important.

10. File Conversion Service

The GLB-to-STL conversion service processes files server-side using Three.js. Conversions strip textures, materials, and animations from the original GLB file and output only the mesh geometry as a binary STL file. We do not guarantee that converted STL files will be watertight or suitable for all 3D printers without additional mesh repair. File uploads for conversion are limited to 100MB per file. Uploaded files are processed in memory and are not permanently stored on our servers. The conversion service is provided free of charge and does not consume credits.

11. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to scheduled maintenance, software updates, infrastructure changes, or circumstances beyond our control (including third-party API outages from fal.ai or other providers). We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We are not liable for any loss, damage, or inconvenience resulting from service downtime or feature changes.

12. Monitoring and Logging

We monitor and log platform activity for security, fraud prevention, abuse detection, and debugging purposes. Logged data includes your IP address, browser user agent, actions performed, timestamps, and associated metadata. Credit transactions are logged with full audit trails including IP addresses. Email interactions (opens, clicks, bounces) are tracked and logged as described in Section 6.4. By using the Service, you consent to this monitoring. 13. Third-Party Services

The Service integrates with and relies upon the following third-party services:

• fal.ai — AI model inference and 3D generation processing
• Polar — Subscription management and payment processing
• Google OAuth — Optional social sign-in authentication
• MongoDB Atlas — Cloud database hosting and data storage
• Resend — Transactional and marketing email delivery

Your use of the Service is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the practices, uptime, or policies of any third-party service. Outages or changes in third-party services may affect the availability or functionality of 3DWebGen.

14. Limitation of Liability

To the fullest extent permitted by applicable law:

• 3DWebGen and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service
• We are not liable for any damages resulting from defects in AI-generated 3D models, including but not limited to failed 3D prints, manufacturing defects, or property damage
• We are not liable for data loss, including loss of generated models, due to third-party service failures or infrastructure issues
• We are not liable for any damages arising from email communications, including but not limited to missed emails, delayed delivery, email filtering by your provider, or reliance on information contained in our emails
• Our total aggregate liability for any and all claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater
• These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages

15. Indemnification

You agree to indemnify, defend, and hold harmless 3DWebGen, its operators, affiliates, officers, and employees from and against any and all claims, demands, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; (d) any content you upload or generate using the Service; or (e) your negligent or wrongful conduct.

16. Termination

• By you — You may delete your account at any time. Active subscriptions should be canceled before account deletion to avoid continued billing. Upon deletion, your data will be removed within 30 days. You will be automatically unsubscribed from all email communications upon account deletion
• By us — We may suspend or terminate your account immediately and without prior notice for: violation of these Terms, abuse of the credit system, fraudulent activity, harmful content generation, non-payment, or any other reason at our sole discretion
• Effect of termination — Upon termination, your right to use the Service ceases immediately. Your remaining credits are forfeited. Your email preferences and unsubscribe status will be retained to ensure we do not send you further communications. We may retain your data as required by law or for legitimate business purposes (fraud prevention, financial records)

17. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. WE MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF GENERATED 3D MODELS FOR 3D PRINTING, MANUFACTURING, OR ANY OTHER SPECIFIC USE CASE. WE DO NOT GUARANTEE THE DELIVERY, TIMELINESS, OR ACCURACY OF EMAIL COMMUNICATIONS, AS EMAIL DELIVERY IS SUBJECT TO FACTORS OUTSIDE OUR CONTROL INCLUDING SPAM FILTERS, SERVER OUTAGES, AND RECIPIENT EMAIL PROVIDER POLICIES.

18. Anti-Spam Compliance

3DWebGen is committed to complying with all applicable anti-spam laws and regulations, including but not limited to:

• CAN-SPAM Act (United States) — All marketing emails include our physical mailing address, a clear identification of the message as an advertisement (where applicable), and a functioning unsubscribe mechanism
• GDPR (European Union) — Marketing emails are sent only with your explicit consent. We record the date, time, and IP address of your consent. You can withdraw consent at any time
• CASL (Canada) — We obtain express consent before sending commercial electronic messages to Canadian recipients and honor all unsubscribe requests promptly
• ePrivacy Directive (EU) — We respect your communication preferences and use tracking technologies in emails only for measuring engagement with our own communications

We never purchase email lists, send emails to harvested addresses, or share your email address with third parties for their marketing purposes. If you believe you are receiving unwanted emails from us, please contact support@3dwebgen.com and we will resolve the issue immediately.

19. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation for a period of 30 days. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of a mutually agreed-upon arbitration institution. Each party shall bear its own costs of arbitration unless the arbitrator determines otherwise.

20. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
