1. Acceptance of Terms

By accessing or using 3DWebGen at 3dwebgen.com (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Service.

We may update these Terms from time to time. Material changes will be posted on the website or otherwise communicated where appropriate. Your continued use of the Service after changes take effect means you accept the updated Terms.

2. Description of Service

3DWebGen provides AI-powered tools for generating, viewing, converting, and downloading 3D models. Features may include image-to-3D generation, text-to-3D generation, multi-view generation, textured or higher-quality generation modes, model history, file conversion, model viewing, and educational content.

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, specific processing times, or that generated outputs will meet every expectation or use case.

3. Accounts and Security

• You must provide accurate account information and keep it current
• You are responsible for keeping your account credentials secure
• You are responsible for activity that occurs under your account
• You must be at least 13 years old, or older where local law requires
• You may not create multiple accounts to abuse free credits, promotions, limits, or restrictions
• Notify us at support@3dwebgen.com if you believe your account has been compromised

4. Credits and Usage

The Service uses credits for certain generation features. Credit costs may vary based on the feature, quality level, and options selected.

• Free credits, if offered, may be limited or changed at any time
• Credits are not cash, cannot be withdrawn, and are not transferable
• Unused subscription credits do not roll over; your balance refreshes to your plan's monthly allocation on each renewal date
• If a generation fails due to a service-side error, credits may be automatically refunded
• We may change credit costs, plan benefits, or free credit allocations with reasonable notice where required
• Abuse of credits, referrals, promotions, or signup bonuses may result in account restriction or termination

5. Subscriptions and Billing

• Paid plans are billed through a third-party payment processor. We do not store full payment card details
• Subscriptions renew automatically unless canceled before the renewal date
• You may cancel your subscription through the billing portal or by contacting support
• After cancellation, you generally retain access to paid features until the end of the current billing period
• Refunds may be requested within 7 days of the initial purchase or renewal and are subject to review
• If payment fails, we may retry the payment, limit paid features, or downgrade the account until payment is resolved
• Upgrades may take effect immediately; downgrades may take effect at the end of the current billing period

6. Email Communications

We may send service-related emails such as account notices, password reset messages, generation updates, subscription notices, security alerts, and important policy or service announcements. These are necessary to operate your account.

If you opt in, we may also send product updates, tutorials, newsletters, or promotional offers. You can unsubscribe from marketing emails at any time through the email link or your account preferences. We may measure basic engagement with our own emails to improve communication quality, as described in our Privacy Policy.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Upload or generate illegal, harmful, abusive, hateful, or exploitative content
• Upload content you do not have the right to use
• Generate or assist with dangerous, violent, or unlawful activity
• Infringe intellectual property, privacy, publicity, or other third-party rights
• Reverse engineer, extract, copy, or misuse any part of the Service
• Use bots, scrapers, automation, or excessive requests without authorization
• Disrupt, overload, probe, or interfere with the Service or related systems
• Bypass account limits, credit limits, payment requirements, or security controls
• Resell, sublicense, or provide access to the Service without our written permission
• Send spam, phishing, deceptive messages, or unauthorized communications

We may investigate suspected violations and take appropriate action, including limiting features, removing content, suspending accounts, terminating accounts, or reporting illegal activity.

8. User Content and Generated Models

You retain ownership of the images, files, prompts, and other content you submit. You grant us a limited license to process that content only as needed to provide, maintain, secure, and improve the Service.

Subject to these Terms, generated 3D models are yours to use, including for personal or commercial purposes. You are not required to attribute 3DWebGen when using generated models.

You are responsible for ensuring that your inputs and generated outputs do not violate any laws or third-party rights.

9. Copyright, Ownership, and Takedown Requests

3DWebGen does not guarantee that any generated model is original, copyright-free, trademark-free, patent-free, or free from third-party claims. AI-generated outputs may resemble existing works, products, characters, designs, logos, trade dress, or other protected material.

To the fullest extent permitted by law, 3DWebGen accepts no responsibility or liability for copyright infringement, trademark infringement, design rights infringement, publicity rights violations, privacy violations, or other legal claims arising from your inputs, generated models, downloads, publications, sales, manufacturing, 3D printing, distribution, or other use of outputs created through the Service.

You are solely responsible for reviewing generated models and confirming that your intended use is lawful before using them commercially, publishing them, selling them, manufacturing them, or distributing them. If you need legal certainty, you should obtain independent legal clearance before using any generated model.

If we receive a credible copyright, trademark, or other rights complaint, we may remove or restrict access to the relevant content, disable links, suspend accounts, or take other action at our discretion. Notices may be sent to legal@3dwebgen.com.

10. 3DWebGen Intellectual Property

The 3DWebGen name, logo, website, software, user interface, designs, documentation, and related content are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from the Service itself except as expressly allowed by these Terms.

11. AI-Generated Content Disclaimer

AI-generated outputs may be imperfect, inaccurate, incomplete, unsafe for certain uses, or similar to existing works. 3D models may contain geometry issues, scale inaccuracies, non-manifold edges, holes, texture issues, or other defects.

You are solely responsible for inspecting, validating, testing, repairing, and approving generated models before using them for 3D printing, manufacturing, commercial products, games, publication, or any safety-critical purpose.

12. File Conversion Tools

File conversion tools are provided for convenience. Converted files may lose materials, textures, animations, metadata, or other original file properties. We do not guarantee that converted files will be suitable for every printer, workflow, slicer, or production use.

13. Service Availability and Changes

We may modify, suspend, limit, or discontinue any part of the Service at any time. The Service may be unavailable because of maintenance, updates, high demand, provider issues, security events, or circumstances outside our control. We are not liable for downtime, delays, output failures, or feature changes.

14. Monitoring and Enforcement

We may monitor usage, account activity, credit activity, file operations, and security events to operate the Service, prevent abuse, enforce these Terms, troubleshoot issues, and comply with legal obligations. See our Privacy Policy for more information about data handling.

15. Third-Party Services

The Service may rely on third-party providers for functions such as AI processing, hosting, storage, authentication, payments, email delivery, security, and support. Your use of the Service may be affected by those providers' availability, policies, and terms. We are not responsible for third-party outages, changes, acts, or omissions.

16. Limitation of Liability

To the fullest extent permitted by law, 3DWebGen and its operators will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to the Service.

• We are not liable for copyright, trademark, privacy, publicity, or other third-party rights claims involving your inputs or generated outputs
• We are not liable for failed prints, production issues, or property damage caused by generated or converted files
• We are not liable for data loss, downtime, delays, provider outages, or interrupted access
• We are not liable for missed, delayed, filtered, or undelivered communications
• Our total liability for all claims will not exceed the amount you paid us in the 12 months before the claim, or $100, whichever is greater

17. Indemnification

You agree to indemnify and hold harmless 3DWebGen, its operators, affiliates, officers, employees, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your content, your generated outputs, your violation of these Terms, your violation of law, your violation of third-party rights, or any copyright, trademark, privacy, publicity, commercial use, manufacturing, distribution, or publication claim related to your inputs or generated outputs.

18. Termination

• You may stop using the Service or request account deletion at any time
• Active subscriptions should be canceled before account deletion to avoid future billing
• We may suspend or terminate accounts for violations of these Terms, abuse, fraud, non-payment, harmful activity, legal risk, or other reasons at our discretion
• Upon termination, your right to use the Service ends and remaining credits may be forfeited unless applicable law requires otherwise
• We may retain certain records where needed for legal, accounting, fraud prevention, security, or dispute purposes

19. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR RELIABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR REQUIREMENTS.

20. Anti-Spam and Communications Compliance

We aim to comply with applicable email and communications laws. Marketing emails are sent only where permitted and include an unsubscribe method. We do not purchase email lists, send emails to harvested addresses, or share your email address with third parties for their own marketing purposes.

21. Governing Law and Dispute Resolution

These Terms are governed by applicable law. Before bringing a formal claim, both parties agree to try to resolve disputes in good faith for 30 days. If a dispute is not resolved, it may be handled through arbitration or another legally available process, unless applicable law provides otherwise.

22. Severability and Waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision does not waive our right to enforce it later.
